    FDV apresenta Observatório Democracia Digital

    A Faculdade de Direito de Vitória (FDV) apresentou de forma oficial, nesta quarta-feira, 19 de julho de 2023, o seu Observatório Democracia Digital (ODD) – núcleo de observação e pesquisa que funciona vinculado ao Programa de Pós-graduação stricto sensu em Direito (PPGD) da faculdade, sob a coordenação do professor doutor José Luis Bolzan de Morais, desde março de 2022.

    A apresentação ocorreu durante uma sessão no pleno do Tribunal Regional Eleitoral do Espírito Santo (TER-ES), no qual foi entregue ao presidente da corte José Paulo Calmon Nogueira da Gama, e aos demais desembargadores presentes, o Relatório da Missão de Observação das Eleições 2022. O documento é resultado do trabalho de acompanhamento da gestão do processo eleitoral pelo Sistema de Justiça Eleitoral brasileiro, missão que o Tribunal Superior Eleitoral (TSE) credenciou a FDV para realizar.

    O Observatório surge com o propósito de analisar as implicações, impactos e fenômenos decorrentes da revolução digital sobre a Democracia, com enfoque na proteção e promoção dos Direitos e Garantias Fundamentais e da preservação das bases do Estado Democrático de Direito. Fará parte das suas atribuições, entre outras atividades, propor ações concretas, apresentar projetos legislativos, servir como órgão consultor e gerar dados e informações que contribuam com discussões sobre o tema por parte da Administração Pública, do Poder Legislativo e do Sitema de Justiça, bem como da sociedade civil.

    Vinculado ao Programa de Pós-graduação stricto sensu em Direito (PPGD) da faculdade, o Observatório atua com o propósito de analisar as implicações, impactos e fenômenos decorrentes da revolução digital sobre a Democracia, com enfoque na proteção e promoção dos Direitos e Garantias Fundamentais e da preservação das bases do Estado Democrático de Direito.

    “O Observatório projeta o Espírito Santo como um importante centro nacional de produção de dados e informações sobre um tema cuja relevância só deve crescer. Temos visto o avanço das tecnologias de inteligência artificial e certamente muitos desdobramentos importantes ainda virão, para além daqueles já sentidos por todos, tanto positivos quanto negativos”, comenta o professor doutor José Luis Bolzan de Morais, que coordena o ODD desde o início dos trabalhos em 2022.

    Além do professor Bolzan, estiveram presentes na sessão a coordenadora do PPGD/FDV Elda Bussinguer, o diretor administrativo da FDV Jorge Abikair e doutorandos e mestrandos envolvidos no projeto do Observatório. Entre os membros do Pleno, estava o professor Américo Bedê Freire Júnior, juiz federal e substituto da classe dos Juízes Federais do TRE.

    ELEIÇÕES 2022: ORIGEM DO OBSERVATÓRIO

    Apresentado oficialmente agora, o projeto do ODD teve início no ano passado com o credenciamento da FDV para a Missão de Observação Eleitoral nas Eleições 2022 – uma iniciativa inédita do TSE, que visou dar ainda mais transparência ao processo eleitoral, seguindo as melhores práticas internacionais recomendadas pela Organização dos Estados Americanos (OEA). Até então, o TSE estava habituado a receber missões estrangeiras compostas por membros de organismos e instituições internacionais.

    Ao realizar a entrega do relatório na abertura da Sessão do Pleno, a coordenadora do PPGD FDV Elda Bussinguer destacou que o “Observatório concorreu a um disputado edital do TSE que estava então credenciando instituições de ensino para que elas pudessem atuar em uma Missão de Observação Eleitoral. Nós tivemos o privilégio, sendo uma pequena instituição, de um pequeno Estado, de ganharmos esse edital junto com a USP e UERJ, duas importantes instituições, e participamos desse processo envolvendo pesquisadores do Brasil inteiro. E assim escolhemos esta Casa para fazer o lançamento oficial do nosso Observatório de Democracia Digital, agradecidos da importância dessa parceria, agradecidos pelo acolhimento, e sem dúvida pelo apoio de vocês nesse projeto que sem dúvida terá continuidade agora em um importante Observatório”.

    Já o professor José Luis Bolzan de Morais, que esteve à frente da missão na FDV, detalhou que a proposta da missão teve como objetivo acompanhar a gestão do processo eleitoral pelo Sistema de Justiça Eleitoral brasileiro em seus vieses normativo, administrativo e jurisdicional. “Ao final desse processo nós tínhamos a tarefa de apresentar um relatório com os resultados observados ao longo das eleições. Nós conseguimos, através de um processo de mineração de dados junto ao TSE e de acompanhamento de atividades tanto no âmbito administrativo e regulatório, construir um conjunto de informações para chegar nesse resultado que na realidade contempla e reúne todos os dados desse importante processo para que a partir deles, possamos tirar uma série de proposições, e inclusive apresentarmos ao TSE uma proposta de inteligência artificial para a captação de desinformação, que será feita através do nosso Observatório como continuidade desse trabalho”, explicou o professor.

    Em sua fala de agradecimento, o desembargador presidente do TRE-ES, José Paulo Calmon Nogueira da Gama, reconheceu a importância do trabalho desenvolvido por pesquisadores da FDV no Projeto de Observação Eleitoral, e a importante contribuição da instituição na formação acadêmica e jurídica de profissionais junto a sociedade capixaba, referenciando a qualidade do ensino e de seu corpo docente formado por mestres e doutores.
